If you are unable to pay your debts, and you are unwilling to file a consumer proposal or bankruptcy action, then you will have to take legal action to stop it. You will need the resources to go to court (lawyers cost money). A bankruptcy trustee can help with this process.
Other alternatives include:
- Paying the entire debt in a lump sum—of course, it’s unlikely that you have the money to make a lump payment but perhaps a friend or family member is willing to lend it to you. At this point, your creditor is unlikely to negotiate a monthly payment with you.
- Filing a consumer proposal—if your creditors agree to the proposal, it halts all other legal actions pertaining to your eligible debts, including wage garnishment.
- Bankruptcy—unlike a consumer proposal, your creditors don’t have to agree to your bankruptcy. As soon as you file for bankruptcy, wage garnishment stops. Once your bankruptcy is discharged, you will no longer owe money to your creditors, so they will not be able to garnishee your earnings.
