Can I go to jail for not paying my debts?

 
 

In general, no. Debtor prison in Canada was abolished a long time ago. The bankruptcy laws are now written so as to give a debtor a new financial start while ensuring that creditors are repaid as much as is feasible during the period of the bankruptcy. Your debtors can take you to court, but it is a civil proceeding, meaning that more fines can be levied, your wages may be garnisheed, but you cannot be sent to jail.

Exceptions to this include the following circumstances:

  • You are charged and found guilty of income tax evasion and a jail sentence is sought by the Canada Revenue Agency (CRA)
  • You have failed to pay court appointed fines, especially those arising from criminal behaviour.

In these cases, you are facing a jail term because your failure to pay falls under criminal codes. Being delinquent on credit card debt or a bank loan is not criminal behaviour.
