Why did my trustee tell me to file all outstanding tax returns?

 
 

In Canada, before filing for bankruptcy, you MUST file all outstanding tax returns. If you do not, the taxes you owe on unfiled returns will NOT be discharged by bankruptcy and you will still owe the Canada Revenue Agency any outstanding taxes, even after your bankruptcy is discharged. It is very important to talk to your trustee about this and arrange to file any outstanding returns before filing for bankruptcy.

You will need to provide your trustee with the T-4 slips from any year in which you did not file taxes, along with all other relevant documentation. If you do not have your T-4 slips, the Canada Revenue Agency (CRA) can provide them for you, as your past employers were required by law to send a copy of your T-4 slip to both you and the CRA.
